Please read these Terms & Conditions carefully before using the ManifestUp app. By using the App you agree to be bound by these terms.
1. Acceptance of Terms
By downloading, installing, or using ManifestUp ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use the App. These Terms apply to all users, including visitors, registered users, and premium subscribers.
2. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. Users between 13 and 18 must have parental or guardian consent.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. ManifestUp is not liable for any loss or damage arising from your failure to comply with this obligation.
4. Acceptable Use
You agree not to use the App to:
- Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any portion of the App or its related systems.
- Reverse-engineer, decompile, or disassemble any part of the App.
- Use the App for any commercial purpose without our express written consent.
5. User-Generated Content
The App allows you to create and store personal content including scripting/journal entries, voice affirmation recordings, vision board images, and community posts ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant ManifestUp a non-exclusive, royalty-free, worldwide licence to store, process, and display your content solely to provide and improve the App's services.
You are solely responsible for your User Content. ManifestUp does not endorse, review, or guarantee the accuracy of any User Content. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.
6. Community Guidelines
Our Community feature is a space for positive, supportive sharing. You agree to:
- Be kind, respectful, and constructive.
- Not post spam, advertisements, or promotional content.
- Not harass, bully, or intimidate other users.
- Not share personal information about other users without their consent.
ManifestUp reserves the right to remove posts, suspend, or terminate accounts that violate these guidelines without prior notice.
7. Subscription Terms
Certain features of the App require a paid subscription ("Premium"). By subscribing:
- You will be charged the applicable subscription fee at the frequency selected (monthly or annually).
- A 7-day free trial may be offered to new subscribers. Your payment method will be charged at the end of the trial unless you cancel before the trial ends.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
- Cancellation takes effect at the end of the current billing period; you will retain access until then.
- All purchases are managed through Apple App Store, Google Play, or Stripe and are subject to their respective terms. Refunds are governed by those platforms.
8. Intellectual Property
All content, design, code, trademarks, and branding within the App (excluding User Content) are the exclusive property of ManifestUp and its licensors. You may not reproduce, distribute, modify, or create derivative works from any App content without our express written permission.
9. Suspension & Termination
ManifestUp reserves the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the Profile screen.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. ManifestUp does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is entirely at your own risk.
11. Limitation of Liability
To the fullest extent permitted by applicable law, ManifestUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.
12. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which ManifestUp operates, without regard to conflict of law principles.
